Welcome to UNPLUGD. These Terms and Conditions govern your access to and use of the UNPLUGD mobile application, website, and related services (collectively, the “Service”).

By accessing or using UNPLUGD, you agree to be bound by these Terms and Conditions.

1. Description of Service

UNPLUGD is a digital disconnection and presence-management platform that allows users to step away from their devices while maintaining communication boundaries through automated responses, presence modes, and communication controls.

The Service may include:

• Automated reply messaging

• Presence and status modes

• Communication management tools

• Notification controls

• User dashboards and settings

UNPLUGD is designed to help users build healthier digital habits while remaining reachable when necessary.

2. Eligibility

You must be at least 13 years old to use UNPLUGD.

By using the Service, you represent that:

• You have the legal authority to accept these Terms

• You are using the Service in compliance with all applicable laws

To access certain features, you may be required to create an account.

You agree to:

• Provide accurate and complete information

• Maintain the security of your account credentials

• Be responsible for all activity under your account

UNPLUGD is not responsible for unauthorized access resulting from your failure to safeguard account credentials.

4. SMS Program Terms

Program Name:

UNPLUGD SMS Auto-Reply

Program Description:

UNPLUGD allows enrolled users to enable automated SMS away messages when they are unavailable, offline, or in Unplug Mode. When a third party sends the first SMS message to an enrolled user while this feature is enabled, UNPLUGD may send a single automated, non-marketing response on that user’s behalf indicating that the user is currently unavailable and displaying the user’s selected away message.

Consent and Message Flow:

Users opt in to the UNPLUGD messaging feature during account signup and onboarding by providing their mobile number, agreeing to these Terms and the Privacy Policy, and separately enabling the SMS auto-reply feature within the app. Recipients of UNPLUGD auto-reply messages are individuals who initiate contact by sending the first SMS message to an enrolled user while the feature is enabled.

Message Frequency:

Message frequency varies based on user settings and inbound message activity. A single automated reply may be sent when a sender initiates contact while the feature is enabled.

Cost:

Message and data rates may apply.

Opt-Out:

Reply STOP to opt out of receiving further UNPLUGD SMS messages where applicable.

Supported Message Types:

UNPLUGD messages are service-related and transactional in nature. UNPLUGD does not use this SMS program for marketing, lead generation, or promotional messaging.

5. Messaging and Communications

By using the Service, you acknowledge and agree that:

• Automated responses may be sent through third-party messaging providers

• Standard carrier messaging rates may apply

• Message delivery is not guaranteed

• Messaging services may be affected by carrier, network, device, or platform limitations

You are responsible for ensuring that your use of the Service complies with applicable telecommunications, privacy, and messaging laws.

6. Acceptable Use

You agree not to use UNPLUGD to:

• Send spam, abusive, deceptive, or unauthorized messages

• Harass, threaten, or impersonate others

• Distribute unlawful or harmful content

• Interfere with the Service or its infrastructure

• Use the Service in violation of carrier rules, messaging policies, or applicable law

UNPLUGD reserves the right to suspend or terminate accounts that violate these Terms.

7. Subscriptions and Payments

Certain features of the Service may require a paid subscription.

Subscription terms may include:

• Monthly or annual billing

• Automatic renewal unless canceled

• Pricing presented at the time of purchase

All purchases are also subject to the applicable payment platform’s terms, including those of Apple App Store or Google Play.

8. Intellectual Property

All content, trademarks, logos, software, branding, and other materials associated with UNPLUGD remain the property of UNPLUGD Technologies LLC or its licensors.

You may not:

• Copy

• Modify

• Reverse engineer

• Reproduce

• Distribute

• Create derivative works from any part of the Service without prior written permission.

9. Privacy

Your use of the Service is also governed by the UNPLUGD Privacy Policy, which explains how information is collected, used, and protected.

10. Service Availability

UNPLUGD does not guarantee uninterrupted, secure, or error-free operation of the Service.

To the maximum extent permitted by law, UNPLUGD, its affiliates, officers, employees, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

• Loss of business opportunity

• Service interruptions

• Messaging delays or failures

Your use of the Service is at your own risk.

12. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms, misuse the platform, or create risk or harm to UNPLUGD or others.

You may stop using the Service at any time.

13. Governing Law

These Terms are governed by the laws of the State of New York and the United States, without regard to conflict of law principles.
